3. Definitions, characteristics and regulations on cookies
Cookies are small text files that the sites visited by the user send and record on their computer or mobile device, to then be re-transmitted to the same sites on the next visit. Thanks to cookies, a website remembers the user's actions and preferences (for example, login data, preferred language, font size, etc.), so that they do not have to be indicated again when the user returns to visit that site or browse from one page to another. Cookies are therefore used to carry out IT authentications, monitor sessions and store information regarding the activities of users who access a site. They can also contain a unique identification code that allows you to keep track of the user's navigation within the site itself for statistical or advertising purposes.
While browsing a site, the user can receive on their computer so-called “first-party” cookies – if installed directly by the site manager –, but also cookies from sites or web servers other than the one they are visiting (so-called “third-party” cookies), installed on the terminal by a person other than the site manager himself.
Some operations could not be performed without the use of cookies, which in some cases are therefore technically necessary for the site to function.
There are various types of cookies, depending on their characteristics and functions, which can remain on the user's computer for different periods of time. In this sense, a distinction is made between: the so-called session cookies, which are automatically deleted when the browser is closed, and the so-called persistent cookies, which instead remain on the user's equipment until a predetermined expiry date.
Based on the legislation in force in Italy, the express consent of the user is not always required for the use of cookies. In particular, the so-called “technical cookies” do not require such consent, i.e. those used for the sole purpose of transmitting a communication over an electronic communication network, or to the extent strictly necessary to provide a service explicitly requested by the user. In other words, these are cookies that are essential for the functioning of the site or necessary to perform activities requested by the user.
Among the technical cookies, which do not require explicit consent for their use, the Italian Data Protection Authority also includes:
i. analytics cookies if specific conditions are met;
ii. navigation or session cookies;
iii. functionality cookies;
For “profiling cookies”, on the other hand, i.e. those aimed at creating profiles relating to the user and used in order to send advertising messages in line with the preferences expressed by the same while browsing the web, prior consent from the user is required.
The Website also contains so-called “web beacons”, i.e. tools that generally have the purpose of tracking the behavior of users, verifying whether they have accessed certain content.
Otherwise defined as “tracking pixels”, web beacons are transparent single-pixel images (1x1 images, usually a GIF file) which, when requested from the server, allow you to track the fact that the user is viewing the page that contains it. Tracking pixels are generally installed for the purpose of user profiling for commercial reasons.
4. Cookie Settings
The user can block or delete (in whole or in part) technical and functionality cookies through the specific functions of their Browser. However, we remind you that not authorizing technical cookies could make it impossible to use the Website, view its contents and use the related services. Inhibiting functionality cookies could mean that some services or certain functions of the Website are not available or do not work correctly and the user may be forced to manually modify or enter some information or preferences every time they visit the Website.
The user, in particular, can authorize, block or delete (in whole or in part) cookies through the specific functions of their Browser. For more information on how to set preferences on the use of cookies through the Browser, you can consult the relevant instructions:
5. Methods of collecting and managing consent for the use of cookies
Upon first accessing the Website, a banner containing brief information on cookies is presented to the user. The user is therefore immediately given the opportunity to express their preferences and their will regarding cookies. In particular:
- by clicking on the “Accept all cookies” button, the user consents to the installation, on their device, of all cookies and other technologies functioning on the Website;
- by clicking on the “X” at the top right of the banner, the user does not consent to the installation of profiling and analytical cookies, for which consent is required. Therefore, only technical or anonymized analytical cookies are installed on the user's device, for the installation of which consent is not necessary;
- by clicking on the “Cookie settings” button, the user has the possibility to give specific consent for each category of performance, functionality and targeted advertising cookies, for which consent is required. The user can then click on the “Confirm my choices” button and thus close the banner.
By opening the “Cookie Policy” link, which leads to this extended information (directly from the banner or, subsequently, through a specific link in the footer of the Website), the user, by means of the appropriate button Modify your consent, always has the possibility to change their preferences, granting or revoking their consent to the installation of cookies.
6. Transfer of personal data
The personal data collected through first-party cookies – i.e. installed by GVM – present on the Website, are not subject to transfer outside the European Union. In any case, it is understood that, where necessary, the Controller may also transfer personal data to non-EU countries, guaranteeing from now on that the transfer will take place in compliance with the applicable legal provisions and therefore by stipulating, if and when necessary, specific agreements that guarantee an adequate level of personal data protection, or in any case by adopting the standard contractual clauses provided by the European Commission for the transfer of personal data outside the EU.
With particular reference, however, to transfers of personal data carried out through third-party cookies, please refer to the respective data processing policies at the links indicated in point 4 of this Cookie Policy.
7. Categories of recipients
Personal data collected through cookies may be shared with:
1.persons authorized by the Controller to process personal data who have received adequate operational instructions, have committed to confidentiality or are subject to an adequate legal obligation of confidentiality;
2.subjects delegated and/or appointed by the Controller to carry out activities strictly related to the pursuit of specific purposes (by way of example and not exhaustive, technical maintenance interventions on the systems), rightly appointed Data Processors.
8. Rights of the data subject
Consistent with the provisions of the GDPR, you have the right to ask the Controller, at any time, for access to your personal data, their rectification or cancellation or to object to their processing. The law also allows you to exercise the right to request the limitation of processing in the cases provided for by art. 18 of the GDPR, as well as to obtain the Data concerning you in a structured, commonly used and machine-readable format, in the cases provided for by art. 20 of the GDPR.
Requests can be sent to the e-mail address: gvm-careandresearch@legalmail.it
Finally, we remind you that you always have the right to lodge a complaint with the competent supervisory authority (Garante per la Protezione dei Dati Personali - Italian Data Protection Authority), pursuant to art. 77 of the GDPR, if you believe that the processing of your personal data is contrary to the regulations in force.
